Carl Niehaus serves ANC with a demand letter

The ongoing unpaid salary saga gripping the African National Congress has taken yet another twist, with the party being served with a letter of demand.

Carl Niehaus and McDonald Mathabe approached Mabuza Attorneys to demand the payments of their outstanding salaries from the ANC. In the letter seen by Africa News Global, Deputy Secretary-General Jessie Duarte is given 10 days to ensure that the organization pays the pair their outstanding salaries.

“Give written confirmation that it will pay them their regular monthly salaries from the end of October 2021 onwards. Account for the amounts of R1.116,780 and R742,211 and indicate whether or not it is unable to pay the debts as mentioned above owed to our clients and other employees and also whether its assets exceed its liabilities,” the letter read.

It further stated that failure to respond would result in the pair instituting proceedings to declare the ANC insolvent and require sequestration.

“Other additional steps which may follow will include approaching the IEC for the dissolution or deregistration of the ANC on the grounds that it is no longer a viable political party which complies with the electoral laws of the Republic of South Africa,” the letter concluded.

The letter of demand follows on the criminal charges the pair laid against the National Office Bearers of the ANC and the organization. They have also lodged a formal complaint with the Public Protector against government agencies that failed to execute their legal duties and did not bring criminal charges against the ANC.

Niehaus said the letter of demand is the initial step in the process to declare the ANC insolvent.

“This letter sets in motion a well-considered legal process to declare the ANC insolvent in the event of it being unable to honour its debts and liabilities to staff and other creditors. It is expected for the ANC to prove that its assets exceed its liabilities. If the ANC fails to do so and fails to honour its debts within the 10-day deadline, proceedings will be instituted without any further notice to declare the ANC insolvent and for it to be sequestrated,” he said.
