A legal showdown is looming between Patriotic Alliance (PA) deputy president Kenny Kunene and EFF leader Julius Malema.
Malema has demanded R1 million compensation from the PA after Kunene called him a “cockroach” during a TV interview just after local government elections in November.
Kunene is adamant that he would never apologise and still stands by his words, saying he was ready to defend his words.
The matter is being convened before Judge Makume at the Equality Court sitting in the Gauteng Local Division High Court.
The matter is being case-managed tomorrow, Friday 25 March, which will effectively result in the parties’ legal teams canvassing issues before the Judge which include whether the matter will proceed via an application or trial procedure, estimated duration of the hearing, and time-frames for the filing of further documents at Court.
Kunene is being represented by Aadil Mayet of Mayet Attorneys Incorporated and Advocate Engelbrecht S.C and the Patriotic Alliance is represented by Eugine Botha of Botha and Erasmus Attorneys and Advocate Muhammad Karolia.
Malema is represented by Ian Levitt Attorneys, Advocate Tembeka Ngcukaitobi, and Advocate Premhid. After the case management process which is to be held tomorrow, the parties will have a potential date for the hearing of the matter.
Through his lawyer, Ian Levitt Attorneys, Malema has filed court papers in the Equality Court in Johannesburg, where he demanded a public apology together with R1 million from the PA, adding that he would donate the money to an organisation of his choice. It was after Kunene, and the PA refused to apologise.
